بني نشاط إداري يهدف إىل محاية النظا م العا م بتقييد ممارسة األفراد لنشاطاهتم وهو ما يعرب عنه بالضبط اإلداري و حريات عامة هلؤالء زاد واقع احلال من أمهيتها يف ظل زيادة الوعي القانونـي و ظهور مؤسسات حلماية و تعزيز تلك احلريات ،بني هذين التناقضني الذين تفرض أمهية كل منهما توسيع جماله كان لزاما إجياد حد ألحدمها بغرض محاية األخر و ملا كانت اإلدارة صاحبة امتياز و مركز أمسى وجب وضع حدود لسلطاهتا تتمثل يف احرتا م مبدأ املشروعية أو سيادة القانون يف الظروف العادية و وضع رقابة قضائية فعالة و متخصصة على القرارات الضبطية يف الظروف اإلستثنائية اليت هتدد إستقرار و إستمرارية الدولة.
