Abstract

هتدؼ ىذه الدراسة إىل اؼبنازعات اليت تثار بشأف الدفًت العقارم ، فكاف البد من الوقوؼ على اإلطار اؼبفاىيمي للدفًت العقارم من خبلؿ تعريفو ك طبيعتو القانونية اؼبزدكجة باعتباره قرار إدارم من جهة ،ك عقد إدارم من جهة ثانية ك أنبيتو كقوة ثبوتية إلقرار اؼبلكية العقارية ، كما هتدؼ ىذه الدراسة إىل إبراز ك توضيح أىم اؼبنازعات اليت يبكن أف تثار بشأف ىذا السند ك اعبهات القضائية اؼبختصة بالفصل يف كل نزاع نظرا للطبيعة االزدكاجية ؽبذه اؼبنازعات ، مع أبراز دكر احملافظ العقارم ك صبلحياتو يف إطار سبتعو بامتيازات السلطة العامة ، كما هتدؼ ىذه الدراسة إىل تقييم النصوص القانونية اليت تؤطر ىذا العمل اإلدارم ك عرض أكجو االختبلؼ بُت النصوص القانونية ك اقًتاح إعادة النظر يف ربيُت بعضها ، كما هتدؼ ىذه الدراسة إىل ضركرة توضيح ك ربديد القضاء اؼبختص كأصل يف حل ىذه النزاعات ك ذلك تفاديا للوقوع يف تنازع االختصاص Cette étude a pour but de mettre relief les conflits qui surgissent en ce qui concerne le livret foncier. Ceci étant, il fallait marque l'importance de ce fait, compte tenu du cadre conceptuel du livre foncier, de sa double nature juridique, comme une décision administrative d'une part, et un contrat de gestion d'autre part et son importance en tant qu'identification pour l'adoption d'un bien immobilier. En plus , cette étude , a pour but de mettre en évidence et de clarifier les conflits les plus importants qui peuvent survenir sur ce fait et les autorités judiciaires compétentes pour statuer sur tout les conflits en raison de la nature de la duplication de ces conflits , en soulignant le rôle du conservateur foncier et de ses prérogatives dans le cadre de la validité et de la jouissance des privilèges de puissance publique . Cette étude a pour but d'évaluer les textes juridiques qui encadrent ce travail administratif, afficher les différences entre les textes juridiques et reconsidérer la mise à jour de certains d'entre eux. Enfin, le but de cette étude tend à souligner et définir la juridiction compétente comme un atout dans ces litiges afin d'éviter les conflits de compétence. To highlight the conflicts that arise regarding the land booklet this study aims.
