لهذا المبدأ ،و في إطار الإصلاحات السياسية التي باشرها النظام ؛ أحدث المشرع اللجنة الوطنية للإشراف على الانتخابات تتشكل حصريا من قضاة يعينهم رئيس الجمهورية ،توضع بمناسبة كل
اقتراع،. كما أحدث المشرع أيضا تغييرا في تشكيلة اللجان الانتخابية المحلية من خلال إضفاء الطابع القضائي عليها ،حيث يترأس كل لجنة انتخابية قاض ،الأمر الذي جعلها تعد إحدى اللجان
المشرفة على العملية الانتخابية .
و لا شك أن إسناد مهمة الإشراف للسلطة القضائية ساهم بشكل كبير في تحقيق قدر من النزاهة و الشفافية على العملية الانتخابية ،و هو ما ظهر من خلال تجربة اللجنة الوطنية للإشراف
على الانتخابات في الاستحقاقين التشريعي و المحلي سنة 2012 ، حيث لعبت هذه الأخيرة دورا هاما من خلال الوقوف على مراحل العملية الانتخابية من مرحلة إيداع الترشيحات ،مرورا بمرحلة
الحملة الانتخابية ،وصولا إلى أهم مرحلة و هي يوم الاقتراع
L’intégrité des élections est devenue une caractéristique des systèmes démocratiques modernes, elle a pour objectif de
mesurer la démocratie de l’état, et afin d'atteindre cette intégrité, l’Algérie adopte un certain nombre de mécanismes à
arriver à la transparence des élections, à savoir le principe de la supervision judiciaire du processus électoral, qui vise
organiser le déroulement du processus électoral afin d'assurer un bon fonctionnement. Et pour La concrétisation de ce
principe dans le cadre des réformes politiques le législateur du Comité national est chargé de superviser les élections
composées exclusivement de juge désigné par le Président de la République, à l'occasion de chaque scrutin placé il a
également un changé la composition des commissions électorales locales, en conférant un caractère judiciaire, où chacun
dirigé par une commission électorale juge, qui en font l'un des comités qui supervisent le processus électoral.
Il ne fait aucun doute que de confier la tâche de superviser le système judiciaire a contribué de manière significative à
atteindre une certaine équité et à la transparence du processus électoral, et démontré par l'expérience de la commission
nationale chargée de superviser les élections au niveau législatif et local en 2012, où elle a joué le un rôle important en se
tenant sur les étapes du processus électoral à partir de l'étape de dépôt des candidatures, en passant par la phase de la
campagne électorale, vers la scène principale qu’est est le jour du scrutin
Integrity of the elections has become a feature of modern democratic systems,it measures the extent of a democratic State;
and in order to reach that desired integrity Algeria adapted a number of mechanisms to activate and devote the integrity and
transparency of the elections quickly. Where it adopted the principle of judicial supervision of the electoral process, which is
intended to frame and organize the course of the electoral process so as to ensure its good movement.
As an embodiment of this principle, and in the context of the political reforms initiated by the system; latest legislator of the
National Comission to oversee the elections exclusively composed of judges appointed by the President of the Republic,
placed on the occasion of each ballot . The legislator also a changed the composition of the local electoral commissions by
conferring a judicial nature, where each electoral commission is headed by a judge,that what make it one of the committees
that overseeing the electoral process.
There is no doubt that assigning the task of supervising to the judiciary contributed significantly take part in achieving a
degree of fairness and transparency of the electoral process, andthat what appeared through the experience of the national
comitee to oversee the elections in legislative and local levels in 2012, where she played an important role through standing
on the stages of the electoral process from the stage of filing the nominations passing through the electoral campaign,
