Abstract

kidnapping is considered one of The serious crimes covered by the different penal laws, including Algerian law sanctions, and international human rights law, and showed the punitive sanctions, in the context of the criminalization of policy aimed to limit this kind of crimes. The sanctions go as far as life imprisonment and death sentence, if the criminal act was accompanied by murder. the Algerian penal legislation imposes death sentence on all different child kidnapping committed for illegal purposes , however national courts decide and impose death sentence , but such dissensions remain implemented. From the point of view of the victim. lack of Implementing death sentence is an unjust treatment and denying the right to, or other lawyers consider death sentenceas contradictory to the basic human right to life
