التبني في القانون الدولي الخاص

Abstract

يشير فقهاء القانون الدولي الخاص إلى أن التبني في مفهومه القانوني نظام يهدف إلى وضع الطفل المتبني في مركز يقترب من مركز الطفل الشرعي، كماأنهيؤثرفيالميراث. لهذافهومحرّمبالكتاب والسنّةوالإجماعلمايحدثهمنخلطفيالأنسابوانتهاكللحرمات،وأن موضوع التبني الذي غالبا ما يتسم بالطابع الدولي نظرا لاختلاف جنسية المتبني والمتبنى تتفق غالبية التشريعات العربية على عدم إجازته تطبيقا لأحكام الشريعة الإسلامية فهده الأخيرة تحرمه تحريما قاطعا نظرا لما يؤدي إليه من نتائج سلبية على الأسرة و المجتمع ككل .Les spécialistes du droit international privé fait référence à la notion d'adoption dans le système juridique visantà adopter des enfants au centre l'approche du statut centre enfantlégitime , car elle affecteL'héritage.
