Abstract

يعد عقد النشر من أهم العقود التي يلجـأ إليها المؤلف لاستغلال إنتاجه الذهني ،بحيث نظمه المشرع بقانون خاص وهو الأمر 2003-05 المتضمن حقوق المؤلف والحقوق المجاورة . بموجب هذا العقد يتنازل المؤلف للناشر على حق استنساخ نسخ عديدة من المصنف حسب شروط متفق عليها وذلك مقابل مكافأة للقيام بنشرها وتوزيعها على الجمهور لحساب الناشر كما يقوم عقد النشر كسائر العقود على التراضي والمحل والسبب وحتى ينشا صحيحا يجب أن تنصب إرادة المؤلف والناشر على شكل مكتوب ومتى توافرت هذه الشروط القانونية رتب هذا الأخير مجموعة من الآثار بالنسبة لطرفيه، إذ يلتزم المؤلف أساسا بتسليم المصنف الأدبي أو الفني إلى الناشر ويقع على عاتق هذا الأخير بصفة رئيسية واجب طبع ونشر وتوزيع هذا المصنف .Le contrat d'édition des contrats les plus importants utilisés par l'auteur d'exploiter la production mentale, de sorte que le législateur a organisé une loi spéciale qui 2003-05 inclus les droits d'auteur et des droits voisins matière.
