الحق في النفاذ الى المعلومات في القانون الجزائري

Abstract

عرف حق النفاذ للمعلومات اهتمام دولي و عالمي ملفت للنظر، فلقد تمت حمايته دوليا باعتباره أداة للتنمية المستدامة و لإدارة الحكم في الدولة، بالإضافة إلى أنه يكتسي دورا في محاربة الفساد الإداري حتى أصبح أساس وجود دولة الحق و القانون، ولقد عرف تكريسه أخيرا في التعديل للدستوري سنة 2016 ليعطي للدولة جانبا آخر من مظاهر الدول الديمقراطية و الانفتاح، فالتأسيس له دستوريا من شأنه تحسين العلاقة بين الدولة و المواطن، و في انتظار قانون خاص ينظم تفعيله فإن الدور يقع على الهيئات الفاعلة في الدولة بالحرص على تثمينه و تسهيل ممارسته من طرف المواطن.Le droit de l’accès à l'information a connu une accrocheuse importance mondiale. Ce droit a été protégé au niveau international puisqu'il est considéré comme étant un outil permettant le développement durable et la bonne gouvernance de l'Etat, en plus de son rôle dans la lutte contre la corruption administrative au point de devenir la base de l'Etat de droit. La modification de la Constitution en 2016 a donné à l'Etat un autre aspect de la démocratie et de l'ouverture, ce qui permet d'améliorer la relation Etat/ citoyen. Et en attendant une loi spéciale régissant son activation, les institutions étatiques devrait faciliter au citoyen l’accès à ce droit.The right of access to information he's get clearly international attention and It has been internationally protected as a tool for sustainable development and governance in the country. It also plays a role in combating administrative corruption. It has become the basis for the existence of a state of law in 2016 to give the state another aspect of democratic states and openness, establishing a constitutional that would improve the relationship between the state and the citizen, and pending a special law to regulate its activation, the role is responsibility on the actors in the State to ensure its value and facilitate the exercise by the citizen
