حريــــــــــــة الاستثمار الأجنبي في التشريع الجزائري و القانون الإتفاقي

Abstract

إن الجزائر كباقي الدول النامية، سعت إلى إيجاد الوسائل و الطرق القانونية من اجل ترقية و تشجيع الاستثمار و جلب الاستثمار الأجنبي ،حيث يعتبر المرسوم التشريعي رقم 12/93المؤرخ في 1993/10/05 ، و الأمر رقم 03/01 المؤرخ في 2001/08/20 أهم التشريعات التي منحت الحرية للاستثمار سواء كان محليا أو أجنبيا ، بهدف النهوض بالاقتصاد الوطني . بالإضافة إلى ذلك قامت الجزائر بإبرام العديد من الاتفاقيات الثنائية و الجماعية الخاصة بالاستثمار في إطار جلب الاستثمار الأجنبي L'Algérie, à l'instar des nations en voie de développement, utilise les moyens et voies juridiques pour développer et encourager l'investissement et attirer les investisseurs étrangers. La loi n 12/93 du 15/10/1993 et l'ordonnance 03/01 du 20/08/2001 sont les textes juridiques qui ont libéré l'investissement local et étrangers et développé l'économie nationale. L'Algérie à aussi conclue de nombreux accords d'investissement dans le cadre d'attirer l'investissement étranger Algeria, as well as the most of developing nations, uses legal ways to develop and encourage investment and attract foreign investors. The act no 12/93 of 15/10/1993 and the ordinance no 03/01 of 20/08/2001 are the legal texts that liberated the local and foreign investment and developed the national economy. Algeria has also signed many investment agreements in the context of attracting foreign investment.
