Abstract

ابتكرت الدول نظام ضمان الاستثمار ضد المخاطر غير تجارية كوسيلة جديدة لرفع الحد الأدنى من الحماية الموضوعية للاستثمارات الأجنبية، ولهذا الغرض جسدت الدول العربية أول نموذج لهذا النظام، وذلك بإنشاء أول هيئة ضمان على المستوى الإقليمي المتمثلة في المؤسسة العربية لضمان الاستثمار، وذلك لتشجيع وتفعيل حركة رؤوس الأموال العربية فيما بينها، ولتحقيق ذلك أخرجت المؤسسة عقد ضمان الاستثمار الى الوجود والذي تلتزم بموجبه بتعويض المستثمر المضمون عن الاخطار غير التجارية والتي قد تصيب مشروعه الاستثماريLes Etats ont inventé le système de garantie des investissements contre les risques non commerciaux comme une nouvelle solution d'élever l'objectif minimum de protection des investissements étrangers, et à cet effet, les Etats arabes incarnent le premier modèle de ce système en créant le premier corps pour assurer le niveau régional de l'Investissement Arabe de Garantie, pour encourager et activer le mouvement du capitaux entre les Etats Arabe, et pour y parvenir l'organisation a construit le contrat d'investissement et le met dans l’existance, qui est engagé à indemniser l'investisseur par lequel le contenu des risques non commerciaux qui peuvent avoir une incidence sur son investissement.
