Abstract

يكتسي مبدأ الملوث الدافع مكانة هامة ضمن مبادئ القانون الدولي البيئي، وتم الاعتراف به في بداية السبعينات كمبدأ اقتصادي في منظمتي التعاون و التنمية الاقتصادية و الجماعة الأوروبية و تطور وأصبح مبدأ قانوني و تم الإعلان عنه بموجب المبدأ 16 من إعلان ريو لعام 1992، حيث ساهم في تطوير و تنويع أساليب حماية البيئة لان قضية البيئة أصبحت ذات طابع عالمي، فمبدأ الملوث الدافع يمثل أساس جديد في فرض ضرائب و رسوم محددة على المتسببين في التلوث من أجل مكافحته، كما يعد بمثابة وسيلة من وسائل تعويض عن الأضرار البيئية ودوره البارز في تطوير قواعد المسؤولية المدنية، وكرسه المشرع الجزائري ضمن قانون البيئة و النظام الجبائي والقوانين القطاعية.Comme principe economiqu dans les deux organisations de la coopération et de derelloppement économique et la communauté europonne il a été annonce en vertu de principe 16 de « Rio » en 1992, principe a contrilru au derellopprment économique et la multiplication des façons pour mieux protéger l’environnent car l’affaire de l’environnent est devenue internationale alors, le principe des source dé imposer des tascepricisees sue des personnes responsable de la pollution afin de luter contre ce phénomène, comme il est considéré comme un moyen de compensation les perte de l’ environnement et son rôle joué au derelloppement des lois de responsalulitécirle.The polluter pays principle is an important place within the principles of international environmental law.
