آليات الترشح في الانتخابات وأثرها على النظام السياسي في الجزائر وتونس

Abstract

تقدم دراسة موضوع آليات الترشح في لانتخابات وأثرها على النظام السياسي في الجزائر وتونس طرحا قانونيا حول الإطار التنظيمي والهيكلي لآليات الترشح للانتخابات الرئاسية والتشريعية في الدولتين، وذلك من خلال دراسة تقارب التشريعين في النظرية العامة للترشح للانتخابات، حيث ترتبط هذه العملية أساسا بالشروط الموضوعية والشكلية للترشح أولا ثم إجراءاته والإشكالات والمنازعات المتعلقة به في الانتخابات الرئاسية ثم التشريعية أيضا، وكذلك الهيئات المختصة به، وكذا العوامل المؤثرة فيه، خاصة تأثير النظام الحزبي ونظام الانتخاب المتبعين. ثم نتطرق بالدراسة بعد ذلك إلى انعكاس هذه الآليات والضوابط على مكانة كل من السلطتين التنفيذية والتشريعية في النظام السياسي في الجزائر وتونس، باعتبارهما تتشكلان في الأساس بواسطة الانتخابات، ويتم ذلك من خلال النظر في صلاحيات رئيس الجمهورية أولا ومكانته في السلطة التنفيذية وعلاقته بالوزير الأول والحكومة ككل في كل نظام، ثم القيام بتحليل العلاقة بين السلطة التنفيذية والسلطة التشريعية، من خلال مظاهر نشاط وتفوق كل سلطة بناء على ما تفرزه نتائج الانتخابات في ظل آليات الترشح المعتمدة في كل دولة

This study investigates the mechanisms of candidacy for elections and its impact on the Algerian and Tunisian political system. It advances the structural and systematic framework of the mechanisms of candidacy for the presidential and legislative elections in the two states, through the study of the convergence of the two Legislations in the general theory of candidacy for the elections. This process is related essentially to the objective and formal conditions for candidacy first, then its procedures, problems and conflicts connected to the presidential elections, then the legislative elections too, as well as the appropriate bodies, and the influential factors of it, in particular the impact of the followed party system and the electoral system. then we move by the study, after that, to the reflection of these mechanisms and controls on the status of each of the two authorities, the executive and the legislative, in the political system in Algeria and Tunisia, because they were formed fundamentally by means of the elections. This is done through the consideration of the powers of the President of the Republic and his position in the executive authority first then for his relationship to the Prime Minister, and with the entire government in each system. Then it analyzes and considers the relationship between the executive authority and the legislative authority for both of them, through the manifestations of the activity and the superiority of each authority on the basis of the results of the elections under the candidacy mechanisms adopted in each state. Résumé : L'étude sur les mécanismes de candidature aux élections et son impact sur le système politique en Algérie et en Tunisie fournit une présentation juridique sur le cadre réglementaire et structurel des mécanismes pour les élections présidentielles et législatives dans les deux pays, et ça fait grâce à l'étude de la convergence des deux Législations dans la théorie générale de la candidature pour les élections. Ce processus concerne essentiellement les conditions objectives et formelles de la candidature, puis les procédures, les problèmes et les différends conflits liés aux élections présidentielles, les élections législatives, ainsi que les organes appropriés et les facteurs influents de celle-ci, en particulier l'impact du système du parti suivi et du système électoral. Puis nous passons par l'étude, après cela, à la réflexion de ces mécanismes et contrôles sur le statut de chacune des deux autorités, l'exécutive et législative, dans le système politique en Algérie et en Tunisie, parce qu'ils ont été formés fondamentalement au moyen des élections. Cela se fait par l'examen des pouvoirs du Président de la République et de son poste dans l'autorité exécutive d'abord pour sa relation avec le Premier ministre et avec l'ensemble du gouvernement dans chaque système. Ensuite, il analyse et considère la relation entre le pouvoir exécutif et le pouvoir législatif pour les deux systèmes, à travers l'analyse de l'activité et la supériorité de chaque autorité sur la base des résultats des élections selon les mécanismes de candidature adoptés dans chaque pays.
