عقد النقل البري للاشخاص

Abstract

الملخـــــص : يعد عقد النقل البري للأشخاص من العقود الرضائية، على أن يلتزم الناقل بإيصال المسافر إلى المكان المقصود ويقوم المسافر بدفع ثمن التذكرة ، حيث يعتبر عقد النقل من بين المواضيع المهمة وهذا نظرا لانتشار المؤسسة العمومية والخاصة بالنقل البري للمسافرين، وتعدد المخاطر التي قد تصيب المسافر وأمتعته ، هذا ما جعل المشرع الجزائري يجتهد ويضــــــــــــــــــــع قــــــــوانين ولوائح تنظم هذا النقل، لتضمن حقوق المسافر جراء تعرضه لأضرار أثناء تنفيذ العقد، وهذا بالمطالبة بحقوقه عن طريق مباشرة الدعوى، في ميعاده المحدد قبل أن تتقادم وهذا حسب القواعد القانونية، وكذا تقدير قيمة التعويض عن الأضرار التي تصيب المسافر، بسبب إخلال الناقل بالالتزام بضمان السلامة
