Abstract

تهدف هذه الدراسة إلى التعرف على ماهية القصد الجنائي في الجرائم الإلكترونية، من خلال التطرق لمفهوم القصد الجنائي في إطار النظرية العامة للجريمة، والنظرية العامة للقصد الجنائي، إضافة لإبراز أهم الطرق والأساليب الخاصة بكشف وإثبات القصد الجنائي التي تنطوي ضمن مهام القاضي الجزائي أثناء المحاكمة، فيحكم بها بناءا على سلطته التقديرية الواسعة. في ذات الإطار فالدراسة تسلط الضوء أيضا على الركن المعنوي في الجرائم الإلكترونية سواء كانت هذه الأنظمة الآلية لمعالجة المعطيات تمثل مسرحا للجريمة أو كانت هي سلاح الجريمة نفسه.

The purpose of this study is to identify the criminal intent of cybercrime by addressing the concept of criminal intent within the framework of the general theory of crime and the general theory of criminal intent, in addition to highlighting the most important methods and methods of detecting and proving criminal intent, Judging by his vast discretion. In the same context, the study also sheds light on the moral element of cybercrime, whether these automated data processing systems represent the scene of crime or the crime weapon itself.
