الأبعاد القانونية والسياسية لاستفتاءات الانفصال حالة كردستان العراق

Abstract

- خلاصة الدراسة : إن انتشار ظاهرة مطالبة بعض الشعوب بالانفصال ، من منطلق أنها تعاني الاضطهاد والتهميش وعدم العدالة الاجتماعية من طرف الدول التي يقعون تحت سلطتها وهناك شعوب أخرى تطالب بالانفصال من منطلق استغلالي ومصالح ذاتية جهوية أو إقليمية ، الأمر الذي استدعى بنا إلى محاولة دراسة الإشكال الذي يبحث في هذه الظاهرة والعناصر التي ساهمت في ظهور وتغذية هذه المطالب ، وقد سعينا من خلال ذلك الإجابة على الفرضيات التي ترى : - أن الظروف التاريخية والسياسات المنتهجة من الحكومة المركزية قد عملت على تنامي الشعور الانفصالي . - المتغيرات الإقليمية والدولية لها دور محوري في نتائج الاستفتاء وعرقلة الطموح الكردي في بناء دولة مستقلة . - النظام الفيدرالي هو النموذج الأمثل لضمان حقوق الأكراد واستقرار دولة العراق . لنصل في نهاية دراستنا إلى التأكيد على صدق هذه الفرضيات التي تم صياغتها وأن استقرار وأمن أي هيئة أو إقليم أو دولة في دوام وحدتها الترابية ولا يمكن أن يكون لها مستقبل أفضل مما هي عليه إذا أرادت الانقسام والانفصال في ظل عدم امتلاكها لمؤهلات اقتصادية وسياسية واجتماعية وأيضا تمكنها من كسب تأييد إقليمي ودولي . /- .

A summary of the study : The spread of the phenomenon of the demand of some peoples for separation. From the logic because they suffering from persecution ،marginalization and lack of social justic by there state. There are other peoples who demand separation from an exploitative logic and regional or regional self interest. Which learding us to try to study the forms that look at this phenomenon and the elements that contributed to the emergence of these hypotheses see that - The historical and political circumstances of the government have fueled a growing sense of secessionism . - Regional and international variables have a key role in the results of the referendum and block the kurdish ambition in building an independent state. - The federal system is the ideal model for guaranteeing the rights of kurds and the stability of the state of Iraq . At the end of our study we can confirm the validity of these assumptions. We confirm too that the stability and security of any state or terriotry is the continuation of its territoriol integrity. No country can have a better future if it wants division and separation in the absence of economic، political and social qualifications،and also enables it to have regional and international support
