تصنيف الجرائم الجمركية في التشريع الجزائري

Abstract

ملخص الموضوع: تعبر خصوصية قانون الجمارك عن مدى خطورة الجرائم الجمركية، لكن وزر الأحكام التي تضمنها التشريع الجمركي و التي يتحملها المخاطبون به، كثيرا ما تجاوزت حدود ما نصت عليه القاعدة العامة. لذلك قام المشرع الجزائري و نظرا لإتساع الرقعة الجغرافية و الحدود الوطنية وحرصا على ردع مرتكبي الجريمة و حماية الإقتصاد الوطني و الوطن، قام بإسناد مكافحتها إلى إدارة الجمارك وفق قانون الجمارك و قانون مكافحة التهريب، كما حدد تصنيفها و أنواعها ضمن مخالفات، جنح، جنايات./

Résumé La spécificité de la Loi douanière reflète la gravité des infractions douanières, mais les dispositions de la législation douanière, qui sont supportées par ceux qui les abordent, dépassent souvent les limites de la règle générale. Le législateur algérien, compte tenu de la vaste zone géographique et des frontières nationales et pour dissuader les auteurs du crime et protéger l'économie nationale et la patrie, a confié son contrôle au Département des douanes conformément à la loi douanière et à la -La loi de la contrebande, ainsi que sa classification et ses types en tant que compensations, délits et crimes.

Abstract The specificity of the Customs Law reflects the gravity of the customs crimes, but the provisions of the customs legislation, which are borne by those who address them, often exceed the limits of the general rule. The Algerian legislator, in view of the wide geographical area and the national borders and in order to deter the perpetrators of the crime and protect the national economy and the homeland, assigned its control to the Customs Department in accordance with the Customs Law and the Anti-Smuggling Law, as well as its classification and types as offenses, misdemeanors and crimes.
