المسؤولية المدنية للصيدلي في التشريع الجزائري

Abstract

يرتكب الصيدلي كغيره من المهنيين أخطاء تقوم بها المسؤولية المدنية ,سواء العقدية أو التقصيرية. ضف إلى ذلك أن المسؤولية التي يتحملها الصيدلي ليست فقط عن أخطائه الشخصية التي يرتكبها أثناء بيعه للدواء أو تحضير المستحضرات الصيدلية , بناء على وصفة الطبيب , بل تمتدد مسؤوليته لتشمل الأخطاء الصادرة من مساعديه , و هي مسؤولية المتبوع و التابع. و في حالة قيام مسؤولية الصيدلي المدنية ,فهو ملزم بتعويض الشخص المضرور (المريض) عن ما أصابه من أضرار و ذلك حسب طبيعة الالتزام الذي أخل به.

Add to this that the pharmacist's responsibility, not only includes his personal faults during the sale, or the preparation of the pharmaceutical drugs, according to a prescription prescribed by the doctor, But his responsibility extends to include the mistakes made by his aides, which is the responsibility of the follower and followed. In the case of the civil liability of the pharmacist, he is obliged to compensate the injured person (patient) for the damage suffered, depending on the nature of the obligation breached.

Le pharmacien comme tout autre professionnel , peut commettre des erreurs qui engagent sa responsabilité civile , tant délictuelle que contractuelle. Ajoute a cela que la responsabilité de pharmacien , ne comprend pas uniquement ses fautes personnelles pendant la vente , ou la préparation des médicaments pharmaceutiques , suivant une ordonnance prescrite par le médecin , et la responsabilité s’étend du commettant de fait de ses proposes. La responsabilité du pharmacien évoque l’indemnisation du malade, des préjudices causés et cela selon la nature de l’obligation contrevenus.
