Abstract: | إن وجود الدولة ضمن الجماعة الدولية يلزمها ببعض القيود التي يفرضها التعامل الدولي في هذا المجال أو التي تمليها ضرورات التعايش المشترك بين الدول , وتتمثل القيود التي يفرضها التعامل الدولي في إلتزام الدولة بتخويل الاجنبي حق اللجوء لقضاء الدولة المقيم فيها , تحقيقا للعدالة للجميع , إلتزام الدولة بإحترام الحصانة القضائية للدول الأجنبية ورؤسائها و ممثيليها الدبلوماسيين , بمعنى أنه لا يجوز أن تقوم المحاكم الوطنية بمقاضات دول أخرى أو الأشخاص ممن يتمتعون بالحصانة القضائية وهذا إحتراما لسيادة الدول والمعاملة بالمثل , والقيود التي يقتضيها التعايش المشترك بين الدول , يجب أن يكون هناك رابطة بين النزاع المطروح والدولة حتى ينعقد الاختصاص القضائي لمحاكمها في الدعوى , وذلك حتى لا يحدث إعتداء على ولاية محاكم الدول الأخرى التي يرتبط ذات النزاع بمحاكمها , التخلي عن الإختصاص اذا كان النزاع منظور امام محكمة أجنبية , قبول الدفع بالإحالة لقيام ذات النزاع أمام محكمة أجنبية وذلك لتجنب حدوث تعارض بين الاحكام . The existence of a state within the international community obliges it to comply with certain restrictions imposed by international cooperation in this area or dictated by the necessities of co-existence between states. The restrictions imposed by international dealing are the obligation of the state to grant the foreigner the right to asylum in the country where he resides. The judicial immunity of foreign States, their presidents and diplomatic representatives, in the sense that national courts may not prosecute other States or persons enjoying judicial immunity, in respect of the sovereignty of States and reciprocity, and the limitations of co-existence In order not to infringe upon the jurisdiction of the courts of other States to which the dispute relates to its courts, to relinquish jurisdiction if the dispute is before a foreign court, to accept payment By referring the same dispute to a foreign court in order to avoid a conflict between the provisions.L’existence d’un État au sein de la communauté internationale l’oblige à respecter certaines restrictions imposées par la coopération internationale dans ce domaine ou dictées par des impératifs de coexistence entre États. Les restrictions imposées par les relations internationales sont l’obligation pour l’État de donner à l’étranger le droit d’asile dans son pays de résidence. L'immunité judiciaire des États étrangers, de leurs présidents et de leurs représentants diplomatiques, en ce sens que les tribunaux nationaux ne peuvent pas poursuivre d'autres États ou personnes jouissant de l'immunité judiciaire, dans le respect de la souveraineté des États et de la réciprocité, ainsi que des limitations de la coexistence Afin de ne pas porter atteinte à la compétence des tribunaux des autres États concernés par le différend, de se dessaisir de sa compétence si le différend est devant un tribunal étranger, d'accepter le paiement En renvoyant le même litige à un tribunal étranger afin d'éviter un conflit entre les dispositions. |
