الجهود الدولية الرامية لتوحيد قانون التجارة الدولية

Abstract

إن الإنفتاح الذي شهده العالم في الميدان التجاري و الإقتصادي سمح للتجارة الدولية أن تأخذ أبعاداً في التوسع والإنتشار عبر كامل أصقاع المعمورة،خصوصاً مع تنامي وسائل الإتصال والمواصلات،التي شهدت هي الأخرى قفزة نوعية جعلت من المعمورة قرية صغيرة جداً، فزالت بفضلها الفواصل بين الشعوب وتلاشت الأبعاد بين الأقطار الأمر الذي أتاح للسلع والبضائع والخدمات أن تتدفق بين المجموعات التي تربطها علاقات إقتصادية،وهذا ما أمكنها من إشباع حاجيات شعوبها من السلع والخدمات التي تفتقر إليها،هذا من جهة وخلق نزاعات دولية صعب حلها لإختلاف قوانين الدول والعادات والأعراف القانونية من جهة أخرى. فجاءت المساعي الدولية إلى توحيد قواعد قانون التجارة العالمية، حيث يقوم الفقهاء ورجال القانون من محكمين وقضاة ببذل جهود كبيرة من أجل تذليل الصعوبات، وحل الإشكالات القانونية للعلاقات العابرة لحدود الدولة، يكون أحد رعاياها طرفاً فيها أو هي في حد ذاتها أو الأشخاص المعنوية التابعة لها، فاقترحوا عددا من الأفكار القانونية والعملية التي تحولت إلى اتفاقيات دولية، أو إقليمية، أو قواعد، وأعراف قانونية أو نماذج تعاقدية، صدرت عن منظمات دولية، مثل منظمة الأونيسترال وغرفة التجارة الدولية.
