دور تفويض المرفق العام في التنمية المستدامة

Abstract

لقدكانت الدولة المسیرالأول للمرافق العامة ، وذلك بموجب أسالیب تقلیدیة ونظرا لتلك التطوراتوالتغیرات التي عرفتهاوظیفتهاوكذاظهورمتطلبات جدیدة للمجتمع من رفاهیةوجودة في الخدمةالعامة،أصبحت هذه الأسالیب عاجزةعن تحقیق المصلحةالعامةللمجتمع فماكان علیهاإلاإتباع أسلوب جدیدوهواتفاقية تفویض المرفق العام لصالح أشخاص القانون الخاص والعام وذلك في مدة زمنیة محددة،مقابل مالي یتحصل علیه صاحب التفویض ویكون مرتبطا باستغلال المرفق،مع ضرورةالحفاظ على الهدف الذي یسعى إلیهالمرفق العام وهوتحقیق المصلحةالعامة ذلك من خلال ممارسةالسلطةالمفوضة لبعض السلطات كمثلاسلطةالرقابة والإشراف،كمایردعلیهابعضالالتزامات تجاههاشأنهاالمفوضله. لعقد تفویض المرفق العام أشكال عدیدة منهاعقدامتيازالمرفق العام وعقدالإیجاروعقد الوكالةالمحفزةوعقدالتسییر،فكل من هذه العقودتبرم من أجل تسییروٕاستغلالالمرافق العامة فهي لیست مؤبدةبل مقیدةبمدةزمنیةوتنتهي إمابنهایةعادیةلمدةالعقدأونهایةمبسترة للعقد

L’ Etat était principalement le premier gerent des services puplics, ces derniers ont été soumi a des méthodes traditionnelles qui sont devenu incapable d’ atteindre l’ interet public, vu l’ évolution et les changements vécus par le role de l’ Etat, d’ où un nouveaux contra administrative a vu le jour dite contra de délégation de service public au profit des personnes de droit privé ou public dans une durée spécifique, en échange d’ une autorisation financiére abtenue par les usages du service puplic qui doit étre substantiellement lier au resultat de l’exploitation, comme il l’indique par certaines obligation en vers le délégataire. Le contrat de délégation du service public a plusieurs forme ;la concession, la régie intéressée, l affermage et de la gérance, chacun de ces contra sont conclus pour l’exploitation de service public pendant une durée limitee, et si ces contra en atteint leur objective en consomment la durée indiquée cela declare que leur fin est normale dans le cas contraire la fin est anticipée.
