حماية الإدارة للنظام العام الاقتصادي

Abstract

مختلف التحولات الحاصلة والتي منها الإصلاحات التي باشرتها الدولة وخاصة التي مست الاقتصاد جعل من الإدارة تفعل آلية جديدة لحماية النظام العام بعدما كان يقتصر دورها على حماية النظام العام بعناصره التقليدية . إذ أصبحت ها ته الحماية تشمل النظام العام الاقتصادي وذلك نتيجة التطورات الحاصلة في الاقتصاد ومنها الانفتاح على السوق وتبني سياسة جديدة والتي ترتب عليها تغير دور الدولة، أدى ذلك لبروز منظومة الضبط الاقتصادي بسلطاته المتعددة في مختلف المجالات والذي أصبحت فيه الدولة تتدخل بطريقة غير مباشرة في ضبط النشاط الاقتصادي بما يسمى بالدولة الضابطة في إطار مراقبة الأنشطة الاقتصادية الممارسة . فهذا الطريق المتخذ من قبل الإدارة المتمثل في الضبط الاقتصادي جاء جراء عجز الإدارة التقليدية عن ضبط المجال الاقتصادي مما استدعى منها تجسيد الضبط الاقتصادي كطريق آخر لحماية النظام الاقتصادي. وسخرت الدولة مجموعة من الوسائل القانونية لهذه السلطات الضبطية من صلاحيات منها إدارية ومنها جزائية ومنها تحكيمية ونظام خاص وغيرها من الوسائل المسخرة لهذه السلطات .

Si la protection du système économique public découle de l'évolution de l'économie, telle que l'ouverture au marché et l'adoption d'une nouvelle politique qui a entraîné une modification du rôle de l'État, le système de contrôle économique, doté de pouvoirs variés dans lesquels l'État intervient indirectement à l’activité économique dans le soi-disant État de contrôle dans le cadre du suivi des activités économiques pratiquées. Cette approche adoptée par l’administration du contrôle économique est due à l’incapacité de l’administration traditionnelle de contrôler la sphère économique, ce qui a rendu nécessaire l’incorporation du contrôle économique comme un autre moyen de protéger le système économique. L’État a eu recours à divers moyens juridiques, tels que des pouvoirs disciplinaires, notamment des moyens administratifs, pénaux, arbitraux, spéciaux et autres qui sont destinés au profit d’elles
