dc.description.abstract | The constitutional amendment of 2016 has seen the consecration of the constitutionality of laws in Algeria through the Constitutional Council, which is composed of 12 members representing the balance of the three authorities, with strict conditions of competence and professional experience in the legal field, with all the guarantees Required for their impartiality and neutrality, as well as their legal immunity. The aim of this study is to examine and analyze the legal system for the formation of the Algerian Constitutional Council in order to link the relationship between the composition of the Council according to the new constitutional amendment and the extent of the exercise of its powers as stipulated in the Constitution. It concluded, inter alia, the absence of legislative framework for the organization of the Algerian Constitutional Council, making the specific rules of procedure flexible and subject to amendment each time. | en_US |
