حق الأقليات في الهوية بين الشريعة الإسلامية والقانون الدولي لحقوق الإنسان

Abstract

تهدف هذه الورقة لدراسة مضمون حماية حق الأقليات في الهوية على ضوء الشريعة الإسلامية والقانون الدولي لحقوق الإنسان وأيضا تقييم أيّ النظامين استطاع أن يقرّ بحقها في الهوية ويضمن حمايته. وقد توصلت الدراسة إلى وجود جهود كبيرة من المجتمع الدولي لإقرار حق الأقليات في الهوية والرقابة عليها، وهذه التطورات كانت نتيجة المآسي التي عاشتها الأقليات ، ومع ذلك ما يزال القانون الوضعي لم يصل لتحقيق حماية كافية لحق الأقليات في الهوية ويبعدها عن التوظيف السياسي. وبالمقابل فإنّ الشريعة الإسلامية سبقت القوانين الوضعية نصا وتطبيقا في رعاية حقوق هذه الفئة وضمانها واقعيا، وهو ما جعل الأقليات تعيش أفضل أيامها داخل الدولة الإسلامية بما يحمي هويتها ويكفل لها الأمن والاستقرار. Abstract: The paper intends to examine the content of the protection enjoyed by minorities in the field of identity under Islamic law and international human rights law, and also to evaluate which system has been able to recognize and ensure their protection. The study found that there were considerable efforts by the international community to recognize and control the right of minorities to identity, and these developments in positive law were the result of tragedies and conflicts experienced and paid by minorities. Nevertheless, positive legal thinking has not yet achieved adequate protection of the right to identity of minorities and has been removed from political employment. In contrast, Islamic law preceded positive laws with Qur'anic and prophetic texts and practical applications in which the rights of this group were actually protected and guaranteed, which made minorities live their best days inside the Islamic State, protecting their rights and ensuring security and stability
