نطاق الصلح الجنائي في الفقه الإسلامي

Abstract

لقد كان للشريعة الإسلامية السبق في نشر روح التصالح والتسامح في المجال الجنائي، مما أضفى على هذا المجال طابعا إنسانيا تفتقده الكثير من التشريعات الوضعية، وهو ما تسعى إلى تحقيقه السياسة الجنائية الحديثة، فقد عملت الشريعة الإسلامية على إرساء قواعد السلام الاجتماعي بين الافراد، وإزالة الآثار المادية والنفسية الناجمة عن اقتراف الجريمة وديا، وذلك بتشريعها لنظام الصلح الجنائي في معظم الجرائم بالرغم من خطورة بعضها أحيانا. Abstract: Islamic law was the first in spreading the spirit of reconciliation and tolerance in the criminal field, which gave this field a human character that lacks many positive legislation, which is what is sought by modern criminal policy, as Islamic law worked to establish social peace rules between individuals, and remove antiquities The material and psychological consequences of committing the crime amicably, by legislating the criminal conciliation system in most crimes, despite the seriousness of some of them sometimes.
