Abstract

قد كان للحقوق المدنية و السياسية نصيب من التعديل الدستوري 2016، فقد كان له وقوف على دسترة حق ممارسة النشاط السياسي المتعلق بالمعارضة و العمل الحزبي كمحور علاقة تعكس الشفافية و المساءلة،بالإضافة إلى ضمان الولوج إلى المعلومة و دوره في بناء مجتمع ديمقراطي يظهر في التداول الحر للمعلومات والممارسة الآمنة للنشاط الإعلامي كمظهر جديد يعكس السعي وراء بناء دولة القانون،و الهدف من هذه الدراسة القانونية محاولة إظهار مساعي الدولة نحو البناء الديمقراطي الذي يعكس تحقيق دولة القانون و لو نسبيا،و بالاعتماد على الدراسة التحليلية التي تنسجم و طبيعة الموضوع تم الوصول إلى نتائج مفادها أن للنص الدستوري دور في تثمين الحقوق المدنية و السياسية و بلورتها وفق مبادئ النظام الديمقراطي الحقيقي.
