الحماية الجزائية للنسب في التشريع الجزائري

Abstract

لقد شهد العصر الحديث ثورة هائلة في مجالات العلوم الطبية والبيولوجية، خاصة تلك التي طبقت على الإنسان تحت هدف الحصول على أطفال من دون حمل أو اتصال طبيعي، ولكنها في نفس هزت صلته بنسبه وبرابط المجتمع من حوله، وعليه فقد حاول المشرع الجزائري مواكبة هذا التطور العلمي، فأقر اللجوء إلى عملية التلقيح الاصطناعي في آخر تعديل لقانون الأسرة بموجب الأمر 05/02، وقام بمعاقبة من يخالف شروطه وأحكامه بموجب قانون الصحة الجديد 18/11، كما أخضع عمليات نزع وزرع الأعضاء البشرية لمجموعة من الأحكام القانونية والتنظيمية، مقابل تجريمه قطعا لعملية الاستنساخ البشري. Abstract: The modern era has witnessed a huge revolution in the fields of medical and biological sciences, especially those that were applied on man in order to obtain children without pregnancy or natural contact, but at the same time shook his connection with his lineage and with the ties of society around him, and accordingly, the Algerian legislator tried to keep pace with this scientific development, so he approved resorting to the artificial insemination process in the last amendment of the Family Law pursuant to Ordinance 2/5, and punished those who violate its terms and provisions under the new health law 11/18, and also subjected the processes of removal and transplantation of human organs to a group of Legal and regulatory provisions, as opposed to absolutely criminalizing the process of human cloning.
