مبدأ الشفافية في مجال نشاط الإدارة العمومية

Abstract

يرتبط تقدم الأمم بمدى تقدم نظمها القانونية والإدارية وما تحتويه من عوامل حاكمة ومنظمة لسلوك و أداء وتصرفات و أعمال الإدارة وعلاقاتها بالمواطنين، ويتجسد هذا الأمر بموجب بمبدأ الشفافية الذي يعتبر نظير مبدأ السرية الذي عرفته الإدارة العمومية في وقت سابق كنمط أصيل، فقد دأبت مختلف النصوص القانونية على مستوى نصوص القانون الدولي أو بالنسبة للقوانين الداخلية للدول في تكريس هذا المبدأ على مستوى النشاط الإداري من خلال الحق في الوصول للمعلومة، وكذا بناء مختلف الأعمال الإدارية وفقا لهذا المبدأ ، إضافة إلى ذلك يجسد مبدأ الشفافية دمقرطة الإدارة من خلال إشراك المواطن في إدارة الشؤون العامة، كما أنه يعتبر الأساس الوقائي لمكافحة الفساد الإداري بمختلف أشكاله.The development of nations depends on the evolution of its administrative and legal systems, contained the controlling and organized factors that regulate the behavior, performance and the relation ship between the administration and its citizens. This is most clearly reflected under the principle of transparency which corresponds to the principle of confidentiality which the public adimistration had undergone over years ago as an original style. Various legal texts had consistently at international law and the level of domistic laws of states had consistently to embody that principe throught the right of access to information and building and governance activities. Furthermore the principle transparency embodies administration democratization throught citizen engagement in managing public affaires. Besides it is considred the factual basis to fight administrative corruption in its various forms
