Implementing the contractual obligation Considering the Corona virus - Covid 19, the newcomer - Force Majeure, according to the Algerian Civil Code

Abstract

Humanity lives today in an exceptional situation that has not been witnessed before, which has an impact on all societal exchanges between members of one community and the global community, where social divergence and domestic stone have become the first priorities that various societies seek to achieve to maintain their societal entities, where contractual obligations constitute the cornerstone. In these dealings, then, judging from these results, we tried in this study to establish a legal vision for the Corona virus - as a new benefit 19 - and can it be considered a force majeure in the field of contractual obligations?تعيش البشرية اليوم وضعا استثنائيا ،لم تشهده من قبل ،أثر على جميع التبادلات المجتمعية بين أفراد المجتمع الواحد والمجتمع العالمي ،وانطلاقا مما شكله الحجر المنزلي الذي فرضته الحكومات على أفراد مجتمعاتها من تبعات على قطاع الاعمال والخدمات ،فقد بات من الضروري اليوم النظر بجدية الى مختلف الافرازات التي انتجها خطط الحكومات على علاقات العمل بين افراد المجتمع الواحد وبين الكيانات المجتمعية العالمية ،حيث الالتزامات التعاقدية تشكل حجر الزاوية في هذه التعاملات ،اذن انطلاقا من هذه النتائج حاولنا في هذه الدراسة وضع رؤية قانونية لفيروس كورونا – كوفيد 19 المستجد – وهل يمكن اعتباره قوة قاهرة في مجال الالتزامات العقدية ؟
