Abstract

تعتبر الوكالة الوطنية الأنشطة المنجمية إحدى هياكل التي وضعها المشرع الجزائري من أجل ضبط النشاط المنجمي غير أن المشرع لم يحدد الطبيعة القانونية لهذه الوكالة ومن هنا كانت إشكالية هذا البحث تدور حول الطبيعة القانونية لهذه الوكالة، حيث اعتمدت في هذه الدراسة على المنهج التحليل من خلال تحليل النصوص القانونية المنظمة للوكالة بالإضافة إلى المنهج الاستنباطي من استنتاج الطبيعة القانونية للوكالة، وتوصلت إلى أن الوكالة الوطنية للأنشطة المنجمية هي سلطة إدارية من حيث وظيفتها وهيئة تجارية من حيث تنظيمها وعليه يمكن القول هي سلطة ضبط اقتصادي من نوع خاص لا تخضع لأحكام القانون الإداري، غير أنها تصدر قرارات إدارية.
