Abstract

من المظاهر المؤسفة في عصرنا ، ما تعرضت له النساء من ظلم وجور ، واعتداء من الرجال ، ولعل ما عرفته الجزائر في عشريتها السوداء من ويلات الاختطاف والاغتصاب ليس عنا ببعيد ، ولا تزال الامة الاسلامية تعاني من الظاهرة في مشرقها الى يومنا هذا. وقد انتشرت ظاهرة اغتصاب النساء بشكل لافت في عصرنا. وان كانت المرأة عانت هذه الظاهرة ، فان طفلها الناتج عن الجريمة ، يظل طول حياته يحمل عبأها ، ذلك ان القضاء يرفض منحه النسب الى من اوجده في الحياة واغتصب والدته ، بحجة عدم وجود عقد الزواج الشرعي ، في حين ان الشريعة الاسلامية السمحاء عالجت هذا الموضوع ، وهو ما دفعنا الى البحث فيه ، لحماية حق الطفل في النسب الى من اغتصب والدته ، لاسيما ان كانت الابوة ثابتة بالبصمة الوراثية AND . كلمات مفتاحية : اغتصاب – طفل – نسب - زواج Abstract: One of the unfortunate manifestations of our time is the injustice and mistreatment of women by men. Perhaps what Algeria has known during its dark decade of abductions and rapes is not far from us, women in orient still suffer from the phenomenon to this day. And if the woman suffers from this phenomenon, her child resulting from the crime, will bear her burden throughout his life, because the judicial power refuses to recognize his right to lineage to the one who gave him birth and raped his mother, Under the pretext of the absence of a legal marriage contract, while the tolerant Islamic sharia dealt with this subject, which prompted us to this research, to protect the right of the child to the lineage of the one who raped his mother, especially if paternity was proved with the DNA fingerprint
