Withdrawal of the insurance company accreditation and its effects in Algerian legislation

Abstract

يهدف هذا البحث إلى تسليط الضوء على سحب الإعتماد بصورتيه، الكلي، والجزئي، والذي يعد إحدى الإجراءات القانونية التي يكتنفها بعض الغموض، إذ نص عليه المشرع الجزائري، وتخضع له شركات التأمين في حالات محددة، أين يتم هذا السحب بموجب قرار يصدر عن الوزير المكلف بالمالية، فيؤدي إما إلى تقليص نطاق نشاطها، أو توقفها نهائيا، وللتعريف به اعتمدنا على المنهج التحليلي الوصفي للنصوص القانونية التي تطرقت إليه، حيث يترتب عنه آثار عدة، بعضها تجاه العملاء المؤمن لهم والمضرورين من أفعالهم في التأمين من المسؤولية، والمستفيدين من عقود التأمين، والبعض الآخر تجاه مستخدميها ووسطائها، أو تجاه شركات تأمين أخرى، أو تجاه عدة هيئات ومؤسسات عمومية. This research aims to shed light at the withdrawal of the accreditation with its both forms, total and partial. It is deemed as one of the legal procedures surrounded by some ambiguity. This accreditation withdrawal was stipulated by the Algerian legislator and insurance companies are subject to it in specific cases. In fact, it takes place under the minister of finance decision which results either in restricting its activity scope or halting it altogether. To introduce it, the descriptive analytical approach to the legal texts, which dealt with it, was relied on. This withdrawal results in myriad effects, some towards the insured clients and those affected by their actions in the liability insurance and the insurance contracts beneficiaries. And others towards its users and intermediaries or other insurance companies or several public organizations and institutions.
