Abstract

يعد موضوع حماية البيئة من المواضيع ذات الأهمية المتجددة كون حياة الإنسان مرهونة باستدامتها وهو ما دفع المجتمع الدولي لإقرار حماية ملائمة لها، وهو الأمر الذي تبناه المشرع الجزائري فبعد أن كانت أولويته دفع عجلة الاقتصاد وبالتالي التركيز على جانب التعمير على حساب الجانب البيئي، تراجع عن هذا المسار محاولا تحقيق توازن بين حماية البيئة والتقدم العمراني في سبيل تحقيق استدامة البيئة، وقد تراوحت الجهود المبذولة في هذا الاطار ما بين محاولة المعالجة القانونية للموضوع بتبني عدد هائل من النصوص القانونية المرتبطة بشكل مباشر أو غير مباشر بحماية البيئة، وبين محاولة تجسيد هذه الحماية على أرض الواقع بإنشاء أجهزة إدارية تناط بها مهمة الاطلاع بمختلف الوظائف والاختصاصات ذات الصلة بقضايا البيئة. The issue of environmental protection is one of the topics of renewed importance, given that human life is subject to its sustainability, which prompted the international community to approve appropriate protection for it. This is something that the Algerian legislator has adopted, after his priority was to stimulate the economy and thus focus on reconstruction at the expense of the environment. He has retreated from this track in an attempt to balance the protection of the environment and urban progress in order to achieve environmental sustainability. indirect protection of the environment, and an attempt to materialize such protection on the ground by establishing administrative agencies with the task of being informed of various functions and functions related to environmental issues
