Abstract

الأملاك الوطنية العامة المخصصة للاستعمال الجماعي يمكن استعمالها أيضا استعمالا خاصا بما لا يتعارض مع استعمالها الأصلي, ويكون ذلك بموافقة الإدارة التي تبرم عقدا مع المستفيد أو تمنح رخصة له مخصصة لهذا الاستعمال حيث أن إبرام العقد يكون بمقابل مالي يدفعه المستفيد. ونظرا للقيمة والأهمية الاقتصادية لهذا الاستعمال فانه يدخل ضمن الاستغلال المثمر للأملاك العمومية الوطنية

Résumé : Les biens publics nationaux désignés pour un usage collectif peuvent également être utilisés pour un usage privé d’une manière qui n’être pas un conflit avec leur utilisation d’origine, c’est avec l’approbation de l’administration qui conclut un contrat aven le bénéficiaire ou lui accorde une licence désigné pour cet usage, où la conclusion du contrat porte sur des frais financiers payés par le Public national property designated for collective use may also be used in a private manner that does not conflict with the original use, and that is with the approval of the administration that concludes a contract with the beneficiary or grant him a license designated for this use, where the conclusion of the contract relates to financial costs paid by the beneficiary.
