مركـز المتعاقديـن في العقـد الإداري الدولـي

Abstract

الملخص: العقد الإداري الدولي من أهم العقود التي تبرمها الدولة لجذب الإستثمارات الأجنبيةللتحقيق التنمية الإقتصادية و الإجتماعية، ويختلف هذا العقد عن غيره من العقود بالنظر إلى مكانة أطرافه، فنجد أن المركز القانوني للمصلحة المتعاقدة يكون أقوى، كونها دولة ذات سيادة، ونظراً لما تتمتع به من سلطات وإمتيازات كبيرة، سواء في مرحلة بناء العقد أو مرحلة تنفيذه، بالرغم من الضمانات الهامة المكفولة للمتعامل المتعاقد الأجنبي والتي تجعله في مركز متوافق معها نسبياً في بعض الأحيان، حيث تعطيه الحق في إدراج بعض الشروط الهامة وغير المألوفة في العقد، كما تمنحه حق إختيار آليات فض النزاعات التي قد تنشب بينه وبين المصلحة المتعاقدة نتيجة للتفاوت في المراكز بينهما. كل هذا كوسيلة لطمأنته وضماناً لحقوقه التي يكفلها له القانون مقابل تنفيذه لإلتزاماته العقدية وإتمامها على أكمل وجه.

Summary: The international administrative contract is one of the most important contracts concluded by the state to attract foreign investments to achieve economic and social development. This contract differs from others due to the position of its parties. So we find that the legal position of the contracting service is stronger, since it is a sovereign state, owing to the powers it enjoys and the great privileges, whether at the stage of building the contract or its implementation. Although, the important assured guarantees to the foreign contracting dealer, which make him in a position relatively compatible with it at times. While it gives him the right to include some important and unfamiliar conditions in the contract. Moreover it allows him to choose mechanisms for ending disagreements that may arise between him and the contracting services as a result of the difference in positions between them. All these things should be means of reassuring him and a guarantee of his rights by the law in exchange for the implementation of his contractual obligations perfectly.

Résumé: Le contrat administratif international est l'un des contrats les plus importants conclus par l'État pour attirer les investissements étrangers afin de réaliser le développement économique et social, ce contrat diffère des autres en raison de la position de ses parties, nous constatons donc que la position juridique du service contractant est plus fort , car c'est un État souverain, et en raison des pouvoirs dont il jouit. Et de grands privilèges, que ce soit dans la phase de la construction du contrat ou la phase de sa mise en œuvre, malgré les garanties importantes assurés au concessionnaire contractant étranger, qui le placent dans une position compatible relativement avec lui dans certains cas, car cela lui donne le droit d'inclure certaines conditions importantes et inhabituelles dans le contrat, ainsi le droit de choisir des mécanismes de dissolution. Les différends qui peuvent survenu entre lui et l'intérêt contractant du fait de la différence de positions entre eux. Tout cela comme moyen de lui assurer et garantir ses droits légitimes par la loi pour exécution de ses obligations contractuelles parfaitement.
