الحماية القانونية لذوي الإحتياجات الخاصة في التشريع الجزائري

Abstract

الملخــــص : تهدف هذه الدراسة الى التطرق لشريحة مهمة في المجتمع ، وهي فئة ذوي الاحتياجات الخاصة ، حيث تشكل الحماية لحقوق ذوي الاحتياجات الخاصة ، و الاعتراف بها من أهم الالتزامات المرتبطة بحقوق الانسان باعتبارها فئة تحتاج الى الرعاية و تأهيل مجتمعي ، مما استدعى ضرورة الاعتراف بحقوقهم ضمن جملة من النصوص القانونية الوطنية و الدولية ، وهو ما جاء به المشرع الجزائري حيث أقر بموجب القانون 02-09 و المتعلق بحقوق الأشخاص المعوقين و ترقيتهم جملة من الحقوق لهذه الفئة ، و التي جاءت في مجملها تهدف الى حمايتهم من كل أشكال التهميش و اللامبالاة .

Abstract : This study aims to address an important segment of society , It is the category of people with special needs , Were it constitutes protection for the rights of persons with special needs is one of the most important human rights obligations , as a group that requires community care and rehabilitation , which necessitates the recognition of their rights within a range of national and international legal texts . This is what the Algerian legislator said according to law no 02-09 concerning the protection and promotion of persons with Disabilities for the year 2002 , a set of rights were granted to this group , which were aimed at protecting them froms of marginalization and indifference .

Résumé : Cette étude vise à aborder un segment important de la société, qui est la catégorie des personnes ayant des besoins spéciaux, où les droits des personnes ayant des besoins spéciaux sont reconnus comme l’une des plus importantes obligations en matière de droits de la personne en tant que groupe qui a besoin de soins et de réadaptation communautaire. Le projet de loi demande la reconnaissance de leurs droits dans une série d’instruments juridiques nationaux et internationaux, comme l’a mentionné le législateur algérien, qui a approuvé par la loi 02-09 sur les droits et la promotion des personnes handicapées un certain nombre de droits dans cette catégorie. L’ensemble de la région vise à les protéger de toutes les formes de marginalisation et d’indifférence .
