خيارات المستأجر عند نهاية عقد الاعتماد الايجاري

Abstract

ملخص إن عقد الاعتماد الإيجاري الذي يعتبر من وسائل التمويل للمشروعات يتميز عن باقي العقود المشابهة له بأنه ذو طبيعة خاصة، و من بين النقاط التي تتجلى فيها هذه الخصوصية نجد أن فترة الإيجار فيه غير قابلة للإلغاء، وكذا تميزه بالخيارات الثلاثة الممنوحة للمستفيد (المستأجر) عند نهاية مدة العقد المتفق عليها، والمتمثلة إما في اكتساب الأصول المؤجرة عن طريق الشراء وهذا مقابل دفع القيمة المتبقية بحيث تأخذ بعين الاعتبار الإيجارات التي تم قبضها، أو أن يتم تجديد العقد لفترة أخرى و بقيمة إيجارية أقل من القيمة الإيجارية السابقة، و في حالة أن المستأجر لم يقم لا بخيار الشراء للأصل المؤجر ولا بخيار التجديد للعقد ما عليه في هذه الحالة إلا أن يقوم برد الأصل المؤجر للشركة المؤجرة لتنتهي العلاقة بينهما.

Résumé Le contrat de crédit-bail, qui est considéré comme l'un des moyens de financement des projets, se distingue des autres contrats similaires en ce qu'il a un caractère particulier, de sorte que cette spécificité est attestée par le fait que la période de location n'est pas sujette à annulation, ainsi que dans les trois options accordées au bénéficiaire (le preneur) à l'issue de la période contractuelle convenue. Et représenté soit en acquérant les actifs loués par achat et ceci en échange du paiement de la valeur restante afin qu'il prenne en compte les loyers qui ont été reçus, soit que le contrat soit renouvelé pour une autre période avec une valeur locative inférieure à la valeur locative précédente, et dans le cas où le preneur ne fait pas l'option d'achat L'actif loué, ni l'option de renouvellement de contrat, a ce qu'il doit dans ce cas, à moins qu'il ne rende l'actif loué à la société de crédit-bail, afin que la relation entre eux se termine.

Summary The leasing contract, which is considered as one of the means of financing projects, differs from other similar contracts in that it has a particular character, and among the points where this specificity is evident, we note that the duration of the lease is not subject to termination, as well as the three options granted to the beneficiary (the lessee) at the end of the agreed term of the contract, represented either by the acquisition of the leased goods by purchase, and this in exchange for payment of the residual value, taking into account the rents received, either for the renewal of the contract for another period of a rental value lower than the previous rental value, and in the event that the tenant does not have the 'option to purchase the leased property or to renew the contract as it should in this case, unless he returns the leased asset to the leasing company for the relationship between them to end.
