موقف المشرع الجزائري من عقوبة الاعدام وأثره في تعطيل الانضمام لاتفاقية روما

Abstract

الملخص كان للأديان السماوية تأثيرا واضحا على تطور القانون الجنائي، فقد حولت العقوبة من إنتقام جماعي إلى فكرة التكفير عن الذنب وذلك عن طريق إنزال العذاب الذي يطهرالجاني من الإثم وهذا من خلال القضاء عليه أو استئصاله عن طريق إعدامه كعقوبة مبررة التي هي أكثر إقناع عندما تكون كجزاء على جرائم تتسم بالبشاعة كالقتل والإبادة الجماعية. لكن مع تطور المجتمع باتت هاته العقوبة تتسم بالقسوة في منظور البعض والذي تولد عليه جدل شديد حول ملائمة التخلي عنها، إذ نادى عدد من الباحثين بإلغائها، فإستجابت لهم تشريعات كثيرة فأسقطت عقوبة الإعدام من قائمتها،بل حتى المبقين عليها لم ينجو من تأثيرها فقد ضيقت من نطاقها، ومنهم من إتجه لتجمييدها مثل الجزائر كحل وسط منها إبقائها كعقوبة رادعة ومن جهة أخرى مسايرة المجتمعات التي ألغتها مع إحترام مبدأ حماية حق الإنسان في الحياة.

Mais avec le développement de la société, cette peine est devenue plus sévére aux geux de graves coutroverses quant à la suppression la peine de mort se nombreux chercheurs ont appelé à son abolition, et plusieurs legislation. y ont répondu .Et malgrés l’achament de certains, partisant de la peine mort, pour mainternir le respect du principe de la protection des droit de l’homme et du droit de la vie

Summary : The celestial religious havehad a clear influence on the devlopment of criminal law in fact converting the sentence ,from a social veugeance to an idea of penance and that in as much the suffering that cleanses the author of sin,and this results in elimination or the eradication of criminality, your execution as a justifiable punishment. But with the development of society, this penalty has become more severe in the eyes of serious controversies about the abolition of the death penalty that many researchers have called for its abolition, and several legislation,responded to it.And despite the attachment of some,advocating the death penalty,to maintain respect for the principle of the protection of human rights and the right to life
