Abstract

This study is devoted to the principle of transparency and the rules of publication enshrined in Article 5 of Presidential Decree No. 24-15, which relates on the one hand to the imposition of substantial formal restrictions linked to the announcement of the request. proposals in detail, as well as precise and specific data. However, the decree authorized the contractor to go beyond the refusal of the visa of the competent procurement commission. Through this study, we tried to link the circumvention mechanism of the visa refusal decision, with the legislative provisions contained in Law 06-01, and we examined the result we reached, the existence of a major flaw and a contradiction, and we have presented a proposal on the matter
