الحق في حرية التنقل في سياق جائحة الكوفيد-19 The right to freedom of movement in the context of the COVID-19 pandemic

Abstract

تنصب هذه الورقة البحثية على دراسة حدود ممارسة الحق في حرية التنقل الذي شهد انتعاشا كبيرا بعد التطور غير المسبوق الذي عرفته وسائل النقل و الاتصال و اتاحتها للأفراد إذ التدابير الاستثنائية الوقائية التي اتخذتها الحكومات للوقاية و الحد من جائحة الكوفيد-19 التي غيرت وجه العالم قد أثرت بشكل غير مسبوق على الحقوق و الحريات المضمونة وعلى رأسها الحق في حرية التنقل بعد غلق الحدود و تعليق الرحلات الجوية الدولية بصورة مفاجئة و سريعة مما نتج عنه عدد كبير من الأشخاص عالقين في الخارج يطالبون بحق العودة الذي كشفت الجائحة عن محدودية و ضرورة تدعيمه ، و تأثر أيضا الحق في الحرية و التنقل داخل التراب الوطني إثر تدابير الحجر المنزلي و أثر في حياة الناس بشكل كبير مما يستوجب تدعيم النظام القانوني لتسيير الازمات في الجزائر . This paper faocuses on the study of the limits of the exercise of the right to freedom movement Which has yet to recover significantly ,following the closure of the border and sudden and rapid suspension of international flights resultion in a large number of people stuck aboroad demanding the right of return which the pandemic revealed its limitations and necessity to support and the right to fredomm and movement within the national territory was also affected by home quarantaine measures and affected people’s lives greatly which necessitates strengthening legal system for managing crises in Algeria .
