الامن القانوني للاستثمار الاجنبي

Abstract

الملخص كما يحتل الاستثمار أهمية كبيرة بالنسبة للدولة والأفراد حيث انه يشكل موضوع اهتمام رجال القانون والاقتصاد والسياسة لأنه يمتد إلى النواح القانونية والاقتصادية والسياسية و يؤثر فيها ويتأثر بها، ويعد تحسين القوانين الداخلية وتوفير الفرص الاقتصادية والانفتاح السياسي للدولة على العالم عوامل جاذبة للاستثمارات من داخل الدولة وخارجها، ولما كان تدفق روؤس الأموال الأجنبية على محيط الدولة يؤدي إلى تغذية مركزة للاقتصاد الوطني مما يقتضي توفير الضمانات اللازمة لتشجيع الاستثمار الأجنبي. ومن متطلباته استقرار القانون ووضوح القواعد القانونية وقابلية القانون للتوقع المشروع والتي هي أهم ركائزه ، أي أن من خلال تجسيد مبدأ الأمن القانوني في الدولة يطمئن المستثمرون الأجانب ويقبلون على استثمار رؤوس أموالهم في الدولة المضيفة ويتأكدون من الحصول على الضمانات والمزايا التي تضمنها قانون الاستثمار09/ 16 المتعلق بترقية الاستثمار وغيره من القوانين الأخرى المرتبطة بالاستثمار الأجنبي. كما يعتبر التحكيم الدولي من بين أهم قضايا الاستثمار التي تطرح بجدية في الوقت الراهن، خاصة في ظل ازدياد التنافس الشديد بين مختلف الدول على جذب اكبر قدر ممكن من الاستثمارات الأجنبية إليها، إلى جانب اتساع حجم العلاقات الاقتصادية بينها، وهذا ما يثير دون شك الكثير من النزاعات التي تعتمد في تسويتها على التحكيم الدولي.

Résumé de l'étude: L'investissement revêt une grande importance pour l'État et les individus, car il constitue un sujet d'intérêt pour les juristes, les économistes et les politiciens car il s'étend, affecte et est affecté par les aspects juridiques, économiques et politiques. L'amélioration des lois internes, l'offre d'opportunités économiques et l'ouverture politique de l'État sur le monde sont considérées comme des facteurs attrayants pour les investissements de l'intérieur et de l'extérieur de l'État, car le flux de capitaux étrangers vers la périphérie de l'État conduit à une alimentation ciblée de l'économie nationale économique, ce qui nécessite de fournir les garanties nécessaires pour encourager les investissements étrangers. Parmi ses exigences, figurent la stabilité de la loi, la clarté des règles juridiques et la prévisibilité des lois, qui est son pilier le plus important, c'est-à-dire, qu'en incarnant le principe de sécurité juridique dans l'État, les investisseurs étrangers sont rassurés et disposés à investir leur capital dans le pays d'accueil. Comme ils sont assurés d'obtenir les garanties et les avantages inclus dans la loi de l'investissement 16/09 relative à la promotion de l'investissement et d'autres lois relatives à l’investissement étranger. L'arbitrage international est également considéré comme l'une des questions d'investissement les plus importantes qui sont sérieusement soulevées à l'heure actuelle, surtout à la lumière de la concurrence intense entre divers pays pour attirer le plus grand nombre possible d'investissements étrangers vers eux, en plus de l'expansion de la volume des relations économiques entre elles, ce qui soulève sans doute de nombreuses inquiétudes, des différends dont le règlement dépend de l'arbitrage international.

International arbitration is also one of the most important investment issues that are being raised seriously at the moment, especially in light of the increased competition between different countries to attract as much foreign investment as possible, as well as the expansion of economic relations between them, which undoubtedly raises many disputes that depend on international arbitration to settle them.
