Abstract

الملخص ان تنفيذ عقود التجارة الإلكترونية تتم عبر شبكة الانترنت ، اطراف التعاقد يتفقان على طبيعة الخدمة والسلعة ، ومن اجل تنفيذ عقود التجارة الإلكترونية نرجع الى القواعد العامة ، كون العقد الإلكتروني ملزم لجانبين فانه كغيره من العقود يرتب التزامات متقابلة في ذمة طرفيه فالبائع ملزم بالتسليم وكذا الالتزام بالضمان . اما التزام المشتري فانه ملزم بالدفع الكترونيا وفيما يتعلق بطرق الدفع فان هناك عدة وسائل موجودة من قبل تما تطويرها الكترونيا ، كما انه هناك وسائل تما استحداثها عن طريق لتكنولوجيا المعلوماتية المتطورة لوسائل الاتصال الحديثة .
