مفهوم عصابات الأحياء بين الاختلاف والتطابق مع مدلول جمعية الاشرار في ظل الامر 20/03 المتعلق بالوقاية من عصابات الاحياء ومكافحتها

Abstract

الملخص أصبح مجرد ذكر عصابات الاحياء يثير الرعب و الهلع في نفوس المواطنين، فقد أصبحت ظاهرة مقلقة تهدد أمن و سلامة المواطنين خلال السنوات الاخيرة، و على عكس أغلب تشريعات العالم التي طبقت أحكام جمعيات الاشرار على عصابات الأحياء فقد سن المشرع الجزائري قانونا خاصا بهذه العصابات في شكل أمر رئاسي تحت رقم 20/03 مؤرخ في 30/08/2020، متعلق بالوقاية من عصابات الاحياء و مكافحتها، مثيرا بذلك جدلا كبيرا حول ضرورة اللجوء إلى تشريع خاص في ظل وجود أحكام مشابهة في قانون العقوبات. الكلمات المفتاحية: عصابات- الأحياء- جمعيات-الأشرار- الأمر 20-03

Study summary: The mere mention of neighborhood gangs has become a source of terror and panic in the hearts of citizens. It has become a worrying phenomenon that threatens the security and safety of citizens in recent years. Contrary to most of the world’s legislation that has applied the provisions of wicked associations to neighborhood gangs, the Algerian legislator has enacted a special law for these gangs in the form of Presidential order No. 20/03 of 08/30/2020, related to the prevention and control of neighborhood gangs, which raised a great debate about the need to resort to special legislation in light of similar provisions in the Penal Code.

Résumé : La simple évocation des gangs de quartier est devenue une source de terreur et de panique dans le cœur des citoyens. C'estdevenu un phénomène inquiétant qui menace la sécurité et la sûreté des citoyens ces dernières années. Contrairement à la plupart des législations mondiales qui ont appliqué les dispositions d'associations malfaisantes aux gangs de quartier, le législateur algérien a édicté une loi spéciale pour ces gangs sous la forme de l'arrêté présidentiel n°20/03 du 30/08/2020, relatif à la prévention et au contrôle des gangs de quartier, qui a soulevé un grand débat sur la nécessité de recourir à une législation spéciale à la lumière de dispositions similaires du Code pénal
