أدوات الرقابة البرلمانية – دراسة مقارنة - بين التعديل الدستوري 2016 ودستور 2020

Abstract

الملخص: تستهدف هذه الدراسة بيان ما هية الرقابة البرلمانية على أعمال السلطة التنفيذية وأ هميتها في منع تجاوز الإدارة في ممارسة اختصاصتها، ومراقبة الأعمال غير المشروعة من قبل الحكومة, كما تستهدف بيان وسائل الرقابة البرلمانية في النظام الدستوري الجزائري. فالرقابة البرلمانية على اعمال الحكومة وفق التعديل الدستوري 2016 ودستور 2020 هي وظيفة يمارسها البرلمان الجزائري إلى جانب الإختصاص التشريعي,والتي تتنوع آلياتها من آليات تترتب عنها مسؤولية سياسية للحكومة,والمتمثلة في الموافقة على مخطط عمل الحكومة,وبيان السياسة العامة,وآليات لا تترتب عنها مسؤولية سياسية للحكومة ,وهي الإستجواب ,والأسئلة الشفوية والكتابية ,ولجان التحقيق, هذه الوسائل التي تؤدي في مجملها إلى تحقيق هدف واحد هو رقابة نشاط الحكومة، وما يمكن أن يترتب عن ذلك من تحريك المسؤولية السياسية للحكومة في حالة خروجها عن تنفيذ سياستها العامة التي وافق عليها البرلمان مسبقاَ

Abstract : This study aims at clarifying the nature of parliamentary control on the acts of the executive authority and its importance in preventing the management from exceeding practicing its competences, and controlling illegal acts by the government, It also aims at clarifying the means of parliamentary control in constitutional system of Algerian. The Parliamentary control on government actions according to the 2016 constitutional amendment and 2020 constitutional, is a function exercised by the Algerian parliament, beside the legislative competence, which has a difference mechanism, include a mechanisms consequent the political responsibility of government which are the according of the government schedule , and the general policy declaration, and a mechanisms don’t consequent a political responsibility which are: interrogation, the oral and writing questions, and the committee of investigation, discussion of foreign policy, and controlling the Using funds of the year , these means lead to one objective, namely , controlling the practices of the government, and considering the consequences that might be resulted upon activating the political liability of the government in case of failing to comply with the implementation of its general policies approved previously by the parliament

Résumé: Cette étude vise à clarifier la nature du contrôle parlementaire sur les actes de l'exécutif et son importance pour empêcher la direction d'outrepasser l'exercice de ses compétences, et contrôler les actes illégaux du gouvernement. Elle vise également à clarifier les modalités du contrôle parlementaire en matière constitutionnelle. système algérien. Le contrôle parlementaire sur les actions du gouvernement conformément à l'amendement constitutionnel de 2016 et à la constitution de 2020, est une fonction exercée par le parlement algérien, à côté de la compétence législative, qui a un mécanisme de différence, comprennent un mécanisme conséquent la responsabilité politique du gouvernement qui sont selon le le calendrier gouvernemental, et la déclaration de politique générale, et un mécanisme n'entrainant pas une responsabilité politique que sont : l'interrogatoire, les questions orales et écrites, et la commission d'enquête, de discussion de politique étrangère, et de contrôle de l'utilisation des fonds de l'année , ces moyens conduisent à un objectif, à savoir , contrôler les pratiques du gouvernement, et considérer les conséquences qui pourraient résulter de l'activation de la responsabilité politique du gouvernement en cas de non-respect de la mise en œuvre de ses politiques générales approuvées préalablement par le parlement
