الحريات السياسية في التشريع الجزائريودورها في ترسيخ الممارسة الديمقراطية)1989-2016(

Abstract

أصبحت الحريات السياسية في عصرنا الحالي من أكثر المصطلحات تداولا في المجتمعات السياسية ذلك لأنها تمثل جوهر الديمقراطية. على غرار المواثيق والاتفاقيات الدولية والإقليمية التي كفلت الحريات السياسية، نجد كذلك المشرع الجزائري نص على تلك الحريات في مختلف الدساتير الجزائرية منذ فترة التعددية السياسية، غير أن الممارسة بينت أن الضمانات الخارجية الدولية والإقليمية والضمانات الداخلية الدستورية لاتزال غير كافية لحماية هذه الحريات. عرفت المنظومة القانونية الجزائرية منذ فترة التعددية السياسية سنة 1989العديد من الإصلاحات التي مست القوانين المنظمة للحياة السياسية، وبالتالي ظلت الحريات في مجال يتسع ويضيق حسب الظروف السياسية الداخلية والخارجية للنظام السياسي الجزائري. كشف الحراك الشعبي السلمي في الجزائر محدودية النصوص الدستورية والقانونية المنظمة للحريات السياسية، مما يستدعي إعادة النظر جملة وتفصيلا في النصوص الضامنة لممارسة المواطن لحرياته وحقوقه.

Nowadays, political freedom is considered as the most used term within political societies because it represents the essence of democracy. In the same way as the international and territorial agreements and treaties on protection of political freedom, the Algerian legislator has equally provided for such freedom in the different Algerian constitutions since the time of political plurality, however in practice, the external international and territorial warranties as well as the internal constitutional warranties are not sufficient to protect such freedom. Since the time of political plurality in 1989, the Algerian legal system has known many reforms in the field of laws governing political life. Therefore, freedoms are varying according to the Algerian political system internal and external circumstances. However, the recent Algerian peaceful Hirak Movement has revealed a great shortage in matter of constitutional and legal texts governing political freedoms, thing that makes it necessary to review legal texts warranting the exercise of the citizen's freedoms and rights.
