Abstract:	الملخص : يكون القاضي مساعد لهيىة التحكيم رغم تحررها من النظام القضائي للدولة مظيفة ذلك ، ان المحكم لا يتمتع بسلطة الإجبار بل هي حكم لقضاء الدولة ، فيتدخل في حالة الضرورة لتفادي إجراءات المماطلة التي يعتمدها الطرف سيء النية ، و مرقبا للحكم التحكيمي من خلال الإعتراف و الأمر بالتنفيذ في الطغن المقدمة إليه . Le résumé en français : Le jegeest assistant au sein de la commission d l' État bôte , puisque l’arbitre ne jouit pas de l’autorité du contraint qu' à la juridiction , Étatique ce qui l'amène à intervenir au besoin afin d’viter la temporisatio qu' adopte la partie de mauvaise foui et comtsôleur du jugement d' arbitrage par sa reconnaissance et ordre de son exécution autre l' essanen des pourvois lui présenter. Summary : The judge is an assistant to the arbitrl tribunal despite its liberation from the the states judicial system adding that the rbitrator does not have the power of compulsion but rther is rulind for the states judiciary so he intervenes in case of necessity toavoid the stalling procedures dopted by the bad faith party and monitors recognition and enforcement in the appeal submitted to him
