Abstract

لقد ترك المستجد التّاريخي المتمثّل في المستعمر الفرنسي الأثر البالغ في نفوس العلماء والفقهاء الجزائريين، يظهر جليا هذا التّأثر في كتاباتهم سواء المؤلفة أو المرسلة، الشّيخان المعسكريّان الميلود بوطالب وعلي بن الحاج واحدين من الذّين تركوا بصمتهم من خلال مراسلاتهم في هذه الفترة خاصة بعد تولّي الأول القضاء بعيدا عن الوطن الرّاشدي. تحاول هذه الدّراسة الجادّة البحث في أحد هذه المراسلات المحفوظة وتحليلها، بغية تفكيك أسرارها وشفراتها والاستفادة منها. كما تهدف هذه الدّراسة إلى إبراز تنوع العلاقات بين علماء القطر الجزائري خلال الفترة العصيبة التّي أعقبت دخول المستدمر الفرنسي إلى بلادنا. لقد استطعنا من خلال الاطّلاع على هذه المراسلة تحديد عدد من النّتائج المتعلّقة بالجوانب الدّينية والتاريخية والاجتماعية والثقافية والأهم من ذلك السياسية، كما أوردت الوثيقة بعضا من أعلام الجزائر في تلك الفترة ساعدتنا كثيرا في التّعريف بهذه الشّخصيات ودورها خلال تلك الفترة. The historical novelty of the French colonialism has left a great impact on the souls of Algerian scholars and jurists. This influence is evident in their writings, whether authored or dispatched. The two military sheikhs, Miloud Boutaleb and Ali bin Al-Hajj, were among those who left their mark through their correspondence in this period, especially after the first took over the judiciary. Far from the home country. This serious study attempts to search and analyze one of these preserved correspondences, in order to decipher their secrets and ciphers and benefit from them. This study also aims to highlight the diversity of relations between the scholars of the Algerian country during the difficult period that followed the entry of the French invader into our country. Through viewing this correspondence, we were able to identify a number of results related to the religious, historical, social, cultural and most importantly political aspects. In the summary, the objective of the research and the results are indicated in two paragraphs.
