دفـــتر الشروط في الصفقات العمومية في المرسوم الرئاسي 15-247

Abstract

الملخص يعــــــتبر دفتــــر الـــشروط الوثيـــــقة الأولى والأساسية في مـــجال الصــفقات العمومية بين المصلحة المتعاقدة والمــــتعامل المتعـــاقد،ويحتوي على بنود تشمل الشروط ولمواصفات التي تعبر عن احتيــــاجات المصلحة المتعاقدة بشكل مفصل ودقيق من الصفقة العمومية، وإعداد دفتر الشروط يجسد مبادئ الحكم الراشد، بما انه يمثل الإطار الرسمي المنظم للعقود الإدارية كونه يمثل كل الشروط المتعلقة بالصفقة. وقد جاءت مواد المرسوم الرئاسي 15-247 حماية للمال العام من الفساد وترشيد النفقات العامةوذلك بواسطة آليات ممارسة الرقابة على دفتر الشروط، كما كفل المشرع الجزائري الحماية القانونية له.
