جرائــم الشيـــك

Abstract

تبحث هذه الدراسة في أحد أهم الأوراق التجارية والتي تعد الأكثر شيوعا في التعاملات المالية وهنا نقصد بها الشيك، الذي أصبح محل اعتداء فترتب عن ذلك جرائم الشيك وهي جرائم الساعة، خاصة مع تطور المعاملات المالية والتجارية. وتكمن أهمية هذه الدراسة في التعرف على الجرائم المرتبطة بالشيك، لأنها تمس بأمن الاقتصاد وحركة الأموال الصادرة والواردة إلى المؤسسات المصرفية، كما أن المشرع الجزائري منح الحماية الجزائية للشيك من أجل تمكينه من أداء وظيفته الأساسية، باعتباره أداة وفاء تقوم مقام النقود، كما نلاحظ أن المشرع قد وفق إلى حد ما في ردع مرتكبي هذه الجرائم من خلال الحماية التي أقرها في القانون التجاري وكذا قانون العقوبات

Résumé: .Cette étude examine l'un des papiers commerciaux les plus importants, qui sont les plus courants dans les transactions financières, et nous entendons ici le chèque, qui est devenu l'objet d'agression, entraînant des crimes contre les chèques, qui sont les crimes de l'heure, surtout avec le développement des transactions financières et commerciales. L'importance de cette étude réside dans l'identification des délits liés au chèque, car il affecte la sécurité de l'économie et le mouvement des fonds entrants et sortants vers les institutions bancaires.Elle a été assez efficace pour dissuader les auteurs de ces délits grâce aux protections établies par le Code pénal et le Code de commerce.

Abstract: This study examines one of the most important commercial papers, which are the most common in financial transactions, and here we mean the check, which has become the subject of assault, resulting in check crimes, which are the crimes of the hour, especially with the development of financial and commercial transactions. The importance of this study lies in identifying the crimes related to the check, because it affects the security of the economy and the movement of incoming and outgoing funds to banking institutions. It has been somewhat effective in deterring the perpetrators of these crimes through the protections established in the Penal Code and the Commercial Code
