إن المنافسة هي المحرك الفعلي للحياة الاقتصادية ، والوسيلة الأنجع لتحقيق عوائد تجارية ، ومن هنا حرصت أغلب التشريعات الحديثة على ضبط الأطر المناسبة لهذا النشاط ، بدأ بتصنيف الممارسات التي تطرأ على هذا المجال إلى ممارسات مشروعة وأخرى مقيدة للمنافسة بدا ب الأمر 03_03 وما لحقه من تعديلات ، ولذات الغرض إستحدث المشرع الجزائري هيئة تعرف قانونا بمجلس المنافسة تناط إليها وظائف إدارية وأخرى قضائية تهدف أساسا لتسوية النزاعات بين المتعاملين الإقتصادين إلاّ أن هذه الكم من القوانين والإجراءات المنصوص، عليها في التشريع الجزائري الناظم لسير المنافسة يظل غير كافي لمواكبة التطور السريع لتحولات الإقتصادية ، يضاف اليه عدم حسم المشرع في مسألة الإنضمام للمنظمات الاقتصادية الكبرى على المستوى الدولي. Summary Competition is the real engine of economic life and the most effective way to achieve commercial returns, hence most of the modern legislations have been keen to adjust the appropriate frameworks for this activity started by classifying the practices in this field to legitimate practices and other restrictive competition started by the order 03_03 The amendments and the pleasures of the purpose the Algerian legislature introduced a law to the Competition Council, which is entrusted with administrative and judicial functions aimed primarily at settling disputes between economic operators. However, these laws and procedures provided for in the Algerian legislation governing the conduct of competition remain insufficient to keep pace with the rapid development of economic transformations, adding to the lack of resolution of the legislator on the issue of accession to major economic organizations at the international level. Résumé: La concurrence est le véritable moteur de la vie économique et le moyen le plus efficace d’atteindre des revenus commerciaux; la plupart des législations modernes ont donc tenu à adapter les cadres appropriés à cette activité, en commençant par classer les pratiques en la matière en pratiques légitimes et autres formes de concurrence restrictive. a commencé par l'ordre 03_03 Les amendements et les plaisirs de la finalité Le législateur algérien a présenté au Conseil de la concurrence une loi qui se voit confier des fonctions administratives et judiciaires visant principalement à régler les litiges entre opérateurs économiques. Toutefois, les lois et procédures prévues dans la législation algérienne régissant la concurrence demeurent insuffisantes pour suivre le rythme de l’évolution rapide des transformations économiques, ce qui ajoute à l’absence de résolution du législateur sur la question de l’adhésion aux grandes organ |
