الصلح في جرائم الاستهلاك

Abstract

إن النشاط التجاري يتسم بالمرونة من خلال المعاملات الناجمة عنه لاسيما ما ارتبط بالعلاقة الموجودة بين المتدخل أو العون الاقتصادي والمستهلك والذي يعد الحلقة الأخيرة لذا وجب حمايته من كل المخالفات المرتكبة في حقه وهو ما حرص عليه المشرع بسن قواعد خاصة توفر له هذه الحماية من خلال قانون حماية المستهلك وقمع الغش وقانون شروط ممارسة الأنشطة التجارية كما اقر الصلح على إثر هذه العلاقة لمعالجة المخالفات المرتكبة لتخفيف العبء عن القضاء وسهولة الإجراءات بين المخالف والإدارة المختصة وذلك بتحديد المخالفات والجرائم الخاضعة لهذا المبدأ حصرا للمحافظة على حقوق المستهلك باقتناء منتوج يتوفر على معايير الأمن والسلامة وفقا لرغبته تحت طائلة العقوبة على المتدخل أو العون الاقتصادي بإجراءات محددة قانونا طبقا لاختصاص الجهات القضائية . كما يرتب الصلح آثارا مميزة بإبرامه وذالك بانقضاء الدعوى العمومية وتثبيت الحقوق بين الطرفين شرط خلوه من عيوب الإرادة . فضلا عن كل هذا أشرك المشرع كذالك جمعيات حماية المستهلك يتأسس كطرف مدني للمطالبة بالتعويض جراء المخالفات المرتكبة في حقهم وهوا ما نلمسه بأن للمستهلك أهمية كبيرة من خلال إحاطته بمجموعة من النصوص تكرس حمايته .

En possédant un produit qui répond aux normes de sécurité et de sureté selon son désir ; sanction de l’interventionniste ou de laide économique selon des procédures définies par la loi .
