Abstract

ملخص : شكلت أزمة كورونا الكثير من الآثار التي مست الالتزامات التعاقدية بشكل واسع سواء على المستوى الوطني أو الدولي , هذه الآثار امتدت إلى عقود الاستثمار دولية ,مما أدى إلى وقف تنفيذ العقد من خلال تفعيل شرط القوة القاهرة , و تفعيل شرط إعادة التفاوض من أجل الدخول في مفاوضات بما يدل على حسن النية في الحفاظ على العقد والمطالبة بإعادة التوازن الاقتصادي المفقود من خلال تخفيف الضرر المترتب عن الجائحة , بل أكثر من ذلك تم اللجوء إلى مؤسسات متخصصة في التأمين بهدف تغطية الأضرار التي أصابت المؤمن لهم , وكذلك إلى التحكيم بهدف فض المنازعات في حال فشل المفاوضات لاستعادة التوازن المفقود و المحافظة على استمرارية العقد . .

Abstract : The corona crisis has had many effects that have affected contractual obligations on a large scale whether at the national or international level , these effects extended to international investment contracts which led to the suspension implementation of the contract by activating condition of force majeure .And activate the condition of re-negotiation in order to enter into negotiations , that indicate good faith in preserving the contract , and the demand for restoring the lost economic balance by mitigating the damage resulting from the pandemic , but more than that , resorting to specialized insurance institutions in order to cover the damage , that befell the insured . As well as to arbitration with the aim of disputes resolution in the event of failure of negotiations to restore the balance lost

Résumé: La crise corona a eu de nombreux effets qui ont affecté les obligations contractuelles à grande échelle, que ce soit au niveau national ou international. ces effets se sont étendus aux contrats d'investissements internationaux ce qui a conduit à suspension l'exécution du contrat en activant une condition de force majeure ,et activer la condition de renégociation afin d'entamer des négociations que témoignent de la bonne foi la préservation du contrat .et la demande de rétablir l'équilibre économique perdu en atténuant les dommages résultant de la pandémie mais plus que cela , en recourant à des institutions d'assurance spécialisées pour couvrir les dommage subis par l'assuré .Ainsi qu'a l'arbitrage dans le but de résolution de litiges en cas d'échec des négociations pour rétablir l'équilibre perdu .
